New Title IX Regulations Coming
In December, the Department of Education notified the public that the proposed new Title IX regulations would be made public in April 2022. The Department of Education recently provided an update on the process, explaining that drafts of the new rules have been sent to the Office of Information and Regulatory Affairs to be reviewed internally.
This is a major first step in the regulatory process. The next step, following internal review, is for the draft rules to be published in the federal register for public comment. While it is important to note new changes are coming, school districts must also remember the current 2020 Title IX regulations remain in effect, and we anticipate the 2020 Title IX regulations will remain in effect for the 2022-2023 school year. School districts must continue to ensure staff are properly trained on the requirements of the 2020 Title IX regulations. Miller, Tracy, Braun, Funk & Miller, Ltd. attorneys are available for training regularly, and asynchronous training is remains available here. We will continue to update schools and universities regularly as we receive updates from the Department of Education.
