Trends in the Schoolyard:
Legal Update and Key Developments in Managing Students

With ever-changing technology issues, schools' developing obligations relating to bullying and harassment, special education considerations, and the detailed practicalities around the most frequent topics of litigation relating to students, our firm hopes to provide attendees with an effective toolkit for approaching each of these issues relating to managing students.

The attorneys at Miller, Tracy, Braun, Funk & Miller, Ltd. will work through the most relevant and helpful topics for any school district to have a strong understanding, using examples, tasks, and tips to help you manage your students effectively.

Due Process & Discipline:  Where Do We Stand?

Luke M. Feeney will discuss discipline issues with students and a routine approach that will ensure Districts afford the appropriate safeguards while upholding high expectations for students.

Legal Trends in Technology Use

David J. Braun will discuss the most current technological issues districts should be savvy of to stay on top of this ever-developing field.

Key Questions in Student Records

Athletics, Extracurriculars, and Legal Claims

Luke M. Feeney will walk through some of the legal claims that can form in the context of athletics and extracurriculars, and help districts avoid some common traps.

First Amendment Update

Many students and adults, believe the first amendment is a blanket protection to be broadly asserted, but David J. Braun will show how it is truly applied in the context of schools and specifically relating to student management.

Emerging Litigation Under Section 504

There is a national struggle over the extent of Section 504 and its relationship to the Individuals with Disabilities in Education Act ("IDEA"), Brandon K. Wright will show how this litigation is developing and show districts safeguards that can be put in place to protect against these costly claims.

Dear Colleague:  OCR's Flood of Recent Guidance

The Department of Education's Office of Civil Rights has been busy, very busy, in issuing guidance that places new requirements on school districts across the nation.  Luke M. Feeney will help districts understand what the OCR process looks like, and how districts can use the guidance avoid the burdensome investigation and reporting processes that accompany OCR complaints.

Bullying, Harassment, and Your Obligations

David J. Braun will highlight the most important statutory developments in bullying and harassment and create a framework for approaching this serious issue with the detail and care that will most protect a district from liability.
